CONT

Undivided co-ownership exists when more than one person owns the same home. No legal transaction is required. For example, undivided co-ownership can be formed from an inheritance. In an undivided co-ownership, each co-owner has a share over the entire property. There is no "private portion" like in a condo. In other words, everybody has the same rights to all parts of the property.

Research that takes the gender dimension into account is found in most scientific disciplines. For instance, a legal research project may investigate how gender-neutral legal rules affect women and men differently. An example of this is the effect of retirement pension rules. In many countries the rules are universal and gender neutral, and pensions are based on previous income. In practice, however, this theoretically gender‑neutral rule may have different outcomes for women and men. Women who have worked part-time or stayed at home to take care of children receive much lower pensions than men(and women) who have worked full-time. In legal research, the gender dimension involves exploring how gender relations influence the distribution of rights and duties, benefits and disadvantages, legal protection and punishment.

Rather than foster full recognition of both English and French in Canadian society, the actions of the Department of Justice would result in diminished opportunities for their use. The breach of obligations under section 41 must also be seen in light of the principle of official language equality under section 16 of the Charter, as well as the recognition that governments in Canada should advance by way of legislative action the equality of status or use of French and English. The principle of equality of our official languages must have substantive effects in order to ensure its full implementation. This imposes a constitutional obligation on the federal government to take the initiative in creating a necessary institutional support to the use of either official language. This obligation is ignored by action that reduces the scope of language rights as they apply to the legal process under federal jurisdiction.

CONT

It is essential to an understanding of legal surveying to appreciate that, at common law, the first creation of a boundary or the demarcation of the extent of rights or ownership in land is absolute and will remain in its original unaltered position for all time. This statement is, however, beguilingly simple. Having said that an original boundary is unalterable, we must also appreciate that the retracement of an original boundary is an exercise in the assessment of evidence.("Law Society of Upper Canada, Real Estate and Landlord and Tenant", 1986-87, p. 95).

As the rules of the common law only recognize A's rights to the property and ignore those of B, A is called the legal owner, while B is called the equitable owner, because his rights are only recognized by virtue of the doctrines of equity. The essential difference between legal and equitable rights is best understood by comparing absolute ownership with trusts....(A) t this point it is only necessary to appreciate that trusts were unenforceable at common law. If land was conveyed to A in fee simple upon trust for B in fee simple, the common law courts regarded A as absolute owner and would not recognise any rights in B. But the Chancellor would enforce trusts, as matters of conscience, and compel A to hold the land on B's behalf and to allow B to enjoy it. In such a case A is the "legal owner", B is the "equitable owner". The land is vested in A, but since he is trustee of it he is not the beneficial owner : he has only the "bare legal estate", and the beneficial interest belongs to B. Now legal ownership confers rights "in rem", rights of property in the land itself, which can be enforced against anyone. Equitable ownership conferred at first only a right "in personam", a right to compel the trustee personally to perform his trust.(Megarry & Wade, 4th ed., 1975, p. 113).

DEF

Notice of certain facts that may be discovered by diligence or inquiry into a public record; a legal presumption that a person is responsible for knowing these facts. The proper recording of a document gives constructive notice to the world of the document's existence and contents. Possession of property also imparts constructive notice of the rights of the party in possession. Examples of rights of parties in possession would be rights under an unrecorded deed, contract for deed, lease-option, and rights of adverse possession. Constructive notice is also referred to as legal notice, in contrast to actual notice, which is express or direct knowledge acquired in the course of a transaction.(Reilly, 2nd ed., 1982, p. 100).

Although at first the "cestui que use" was regarded as merely having a right to compel the feoffees to uses to carry out their duties, the rights of the "cestui que use" were so extensive that it was soon recognized that he had an estate in the land. The legal estate(the bare legal ownership) was in the feoffees to uses, the equitable estate(the beneficial right of enjoyment) in the "cestui que use"...(Megarry & Wade, 4th ed., 1975, p. 153).
