Subject to the direction of the Minister of Natural Resources, the Surveyor General of Canada Lands has responsibility for the management of surveys on Canada Lands. This mandate drives two programs : Canada's Survey Registry, which provides the standards for surveys, registration processes and the archive for legal survey documents; and Canada's Survey Program, which delivers the legal surveys in support of Government of Canada priorities such as those for Aboriginal Lands.

A property surveyor takes precise measurements to identify the boundaries of a parcel of land and prepares reports, maps, and plots that are used for construction, deeds, or other legal documents. A property surveyor determines the precise location of roads, buildings, and other features that are used to determine any changes to the property line, restrictions on what may be built on a property or where new structures must be located, how large structures may be, and the appropriate building depths for foundations.

The word "title" has over the years acquired a meaning in general use which is normally thought of as covering all of the interests of an owner in land. We find that the word is used as, "I have surveyed this man's title" and "The title to this man's land is free of encumbrances. "In these two examples, the word "title" has a completely different meaning. In the first instance, "title" is intended to mean extent of title, the boundaries of the land. And in the second instance, "title" is intended to mean the chain of title, the factors which affect the ownership of the land... In legal surveying and land ownership, the word "title" should be qualified or explained by defining it as either "Chain of title"-the province of the lawyer, or "Extent of title"-the province of the surveyor.(Lamont, "Real Estate Conveyancing, "1976, pp. 552-553).

In its general sense, the determination of astronomic bearings and distances between points permanently or temporarily marked on the ground and includes the keeping of records of all measurements used in the determination.

"Survey", in its legal sense, means the determination of all the monuments or landmarks that mark a boundary and the survey of all the lines constituting the boundary. It includes the preparation of field notes and plans and any examination, approval or confirmation that may be required of the Surveyor General and other officers under the provisions of the ["Canada Lands Survey"] "Act" or other statutory authority.("Manual of Instructions for the Survey of Canada Lands", 2nd ed. 1979, p. B2 : 3).

In all cases, a survey of the subject property conducted by a registered NB land surveyor, is required, the cost of which is the responsibility of the applicant. When the survey is completed it must be submitted to the Crown Lands Branch(NBDNR) by the surveyor(i. e., a Return of Survey). When that has been received, the necessary legal procedures to transfer the property to NBDAFA [New Brunswick Department of Agriculture and Aquaculture] will be carried out.
