A second response to the question of how to determine legislative intent is currently labelled intentionalism. Like textualism, this theory makes the legislature's intention the primary touchstone of interpretation. But unlike textualism, it does not rely exclusively on the text of the legislation for evidence of that intent. Intentionalists are willing to consider and, in a proper case, rely on any evidence of legislative intent, so long as it meets a threshold test of relevance and reliability. 1, record 1, English, - intentionalism

The [Iowa Supreme Court] affirmed the trial court's refusal to render a foreclosure decree ordering a sale of the property involved to repay the mortgage held by the plaintiff and pointed out that the Iowa code expressly required the filing of the instrument, the copying of the instrument into the record book, and the indexing of the instrument. Relying on the purposes for the establishment of a system of recordation, the court interpreted the legislative intent as requiring the indexing of an instrument before there could be valid recordation.(Axelrod, Berger and Johnstone, 1971, pp. 552-553). 1, record 2, English, - indexing

Although in considering the purpose of the NB OLA [Official Languages Act of New Brunswick], the Court of Appeal referred to Beaulac and acknowledged the importance of an interpretation that emphasizes “the protection and development of official language communities”, we submit that it relegated the purpose of language rights to the second tier. Instead, it relied on other “indicators” of legislative intent, including the overall scheme of the Act and the principle of the statutory coherency, which, in our submission, became the determining factors in its analysis. 1, record 4, English, - indicator%20of%20legislative%20intent

1, record 4, French, - indicateur%20de%20l%27intention%20du%20l%C3%A9gislateur

The appellants argued that the definitions of "family status" and "marital status" imply a legislative intent to restrict these grounds to complaints based on a person's "absolute status", i. e., the mere fact of being married, single, etc., or the fact of being in a certain type of family, and do not extend to complaints based on the particular identity of family members. 1, record 8, English, - absolute%20status

1, record 8, French, - %C3%A9tat%20au%20sens%20absolu

Because of the importance of the legislative purpose, the objective component of s. 21(2) can be justified with respect to most offences. However, with respect to the few offences for which the Constitution requires subjective intent, the stigma renders the infringement too serious and outweighs the legislative objective which, therefore, cannot be justified under s. 1. 1, record 9, English, - subjective%20intent

1, record 9, French, - intention%20subjective
