A second response to the question of how to determine legislative intent is currently labelled intentionalism. Like textualism, this theory makes the legislature's intention the primary touchstone of interpretation. But unlike textualism, it does not rely exclusively on the text of the legislation for evidence of that intent. Intentionalists are willing to consider and, in a proper case, rely on any evidence of legislative intent, so long as it meets a threshold test of relevance and reliability.

In that case, which involved the interpretation of the Radiocommunication Act, the Court did a contextual and purposive analysis of the Act in order to determine whether the provision in issue was ambiguous. It concluded that it is only when genuine ambiguity arises between two or more plausible readings, each equally in accordance with the legislative intention, that the courts need to resort to the subsidiary principles of interpretation, such as the “Charter values” presumption.
