This duty of honesty "is a general doctrine of contract law that applies to all contracts" and consequently, parties are not free to exclude it... This means simply that parties must not lie or otherwise knowingly mislead each other about matters directly linked to the performance of the contract.... Recognizing a duty of honest performance flowing directly from the common law organizing principle of good faith is a modest, incremental step. 1, record 1, English, - duty%20of%20honest%20performance

Thus the concept of acts of a mere sufferance contains elements over and above that of knowledge. Its real basis seems to lie :(a) in an obligingness on the part of the owner, who is acting as a good neighbour(used in a broad sense) and tacitly permits acts to be carried out on his property which are advantageous to the author of the acts without causing appreciable damage to the property and without the owner in any way abandoning his claim to ownership, such permission being revocable at any time;(b) in the absence of any intention on the part of the author of the acts to make the property his own; and(c) in the fact that the acts themselves will not be sufficient to constitute a possession. 3, record 2, English, - act%20of%20sufferance

In an anchorage where there is little or no current or tidal stream, and in reasonably calm weather, a ship may be pointed to lie at an angle with the line of her cable by putting a spring on her cable. First heave in a shackle or so of cable. Now lead a hawser [...] out through the aftermost quarter fairlead, then for’ard and outboard of all, and shackle it with a joggle shackle to the cable outboard of the hawsepipe, thereby forming a spring. Then belay the hawser and veer the cable, and the ship's head should pay off away from the side on which the spring is rove until pointing in the required direction. A land-locked sea has no connection with the open sea, and may be assimilated to a mere lake. This may lie within one... State or, like the Caspian Sea, between two States. In the latter case, there is a division of the waters between the two States concerned. The legal status of inland and land-locked seas is that of internal waters, that is to say they are under the full sovereignty of the coastal state. Foreign warships require special permission to enter inland seas, and merchant ships are required to satisfy any conditions which may be laid down by the territorial state. 1, record 59, English, - land%2Dlocked%20sea

closed sea: The term "enclosed sea" ... should not be confused with the term "closed sea." Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47). 2, record 95, English, - consideration

It is clear, however, that courts in different countries are capable of cooperating with each other and coordinating their administrations in the case of a cross-border or multinational reorganization or insolvency. The key to this increased willingness to cooperate and coordinate may well lie in the experience gained from cross-border insolvency protocols that have been negotiated in recent cases and from the example of the International Bar Association's Cross-Border Insolvency Concordat. 2, record 97, English, - cross%2Dborder%20insolvency%20protocol
