A civil claim resulting in a judgement of the nature of a command or prohibition directed against the unsuccessful party and only consequentially against his property in that he may suffer his property being sold to satisfy the judgment. It is distinct from a "personal action" under the former system of forms of action ... and also from an actio personalis within the meaning of the maxim actio personalis moritur cum persona ... which was an action so connected with an individual that it fell on his death.

personal action : The term is now frequently given to an action "in personam", where the judgement of the court is a personal one, normally for payment of money, as contrasted with an action in rem, where the plaintiff seeks to make good a claim to or against certain property in respect of which, or in respect of damage done by which, he alleges that he has an actionable demand.

Vu notre réserve habituelle à l'égard des mots latins, certains seront étonnés de constater que nous recommandons d'utiliser, en français, les syntagmes «action in rem» et «action in personam» plutôt que les formes «action réelle» et «action personnelle» qu'on trouve dans les lois canadiennes. La raison est simple : si le terme anglais «action in rem» devait être rendu par «action réelle» (ce qui ne poserait pas de problèmes en soi), comment alors traduire les termes voisins tels «judgment in rem», «jurisdiction in rem», «proceeding in rem» et «writ in rem»? Il est permis de douter que la tournure «procédure réelle» puisse passer dans l'usage...

Yet the commercial viability of farming in these areas has been increasingly dependent upon various headage payments which have led to environmental degradation through over-grazing. Under Agenda 2000, one headage payment(the Hill and Livestock Compensatory Amount or HLCA) is to be switched to an area basis. This represents a partial attempt to decouple support from production incentives and may reduce environmental damage. However, the response of farmers to this payment switch is uncertain, particularly given the continuance of various other headage payments.

La modification récente du mode d'octroi de l'ICHN [Indemnités Compensatoires de Handicaps Naturels] (passage d'une aide à la tête de bétail à une aide à l'hectare, plafonnée à 50 hectares par exploitation), intervenue suite à une modification des règles européennes relatives au développement rural, semble plutôt favorable sur le plan environnemental. Pour prétendre à cette aide, les agriculteurs doivent s'engager à poursuivre une activité agricole en zone défavorisée pendant une période minimale de 5 ans. Ils doivent, de plus, se conformer aux bonnes pratiques agricoles habituelles et respecter les normes de chargement animal fixées par arrêté interministériel pour chaque zone défavorisée.

En 1990, des paiements ont également été introduits pour soutenir l'élevage laitier au cours de l'été, afin de contribuer à l'entretien du paysage cultural par le pâturage des animaux, et un paiement par tête de bétail a été introduit en 1998 pour stimuler l'utilisation et la gestion de champs isolés pour maintenir la diversité biologique.

The Commission can cancel a license if an elevator operator is convicted of an offence under the act or has failed to provide additional security to cover liabilities for grains. Such an order is subject to review by the Minister of Agriculture Canada. The Commission can request payment for loss or damage resulting from a violation of the act.

Satisfaction may be defined as any measure which the author of a breach of duty is bound to take under customary law or under an agreement by the parties to a dispute, a part from restitution or compensation. Satisfaction is an aspect of reparation in the broad sense. However, it is not easy to distinguish between pecuniary satisfaction and compensation in the case of breaches of duty not resulting in death, personal injuries, or damage to or loss of property. Claims of this sort are commonly expressed as a claim for an "indemnity". If there is a distinction, it would seem to be in the intention behind the demand. If it is predominantly that of seeking a token of regret and acknowledgment of wrongdoing then it is a matter of satisfaction. The objects of satisfaction are three, which are often cumulative; apologies or other acknowledgment of wrongdoing by means of a salute to the flag or payment of an indemnity; the punishment of the individuals concerned; and the taking of measures to prevent a recurrence of the harm.
