It [payment under protest] often occurs [when] payment is demanded of a debtor who, although quite convinced he owes nothing, realizes that failure to pay would result in serious prejudice to himself. It was decided that, in such cases, the debtor may pay under protest, that is, execute the obligation while at the same time declaring that he owes nothing, and that such payment cannot therefore be taken as tacit or express recognition of the fact that payment is due or that the debt exists.... payment under protest brings about a shifting of the burden of proof : the right of recovery arises in favour of the payer unless the person who has received the payment proves that such payment was in fact due. 1, record 4, English, - payment%20under%20protest

The Court also distinguished between the legal right of redemption in foreclosure proceedings and a borrower's contractual right to reinstate a defaulted loan. By law, a defaulting borrower in foreclosure is entitled to redeem his or her property by paying the entire principal and interest due before confirmation of the sheriff's sale. When that happens, the lender has a legal duty to dismiss the foreclosure proceedings and may not condition that dismissal on payment of attorney fees. This differs from a contractual right to reinstate a loan. In that instance, the borrower typically pays only the amounts needed to make the loan current and continues all future payments on the previously agreed-upon schedule. 3, record 14, English, - legal%20right%20of%20redemption

A rent charge arises when a periodic sum of money is payable in respect of land to a person who has no reversion in it, the due payment of which is a charge upon the land and is secured by a right of distress given by express agreement between the parties. A rent charge in fee simple is an incorporeal hereditament and is real property as it is an interest in the land itself. Extinguishment. The term has, in the law, no fixed, uniform and universal meaning, but varies with the subject matter to which it is applied; but usually it connotes the end of a thing, precluding the existence of future life therein, and has been defined generally as meaning a complete wiping out, destruction, or annihilation, and not a mere suspension; the destruction or cancellation of a right, power, contract, or estate; a discharge by operation of law; a termination; and, more specifically, as the annihilation or extinction of a right by its being consolidated with a greater or more extensive right; the extinction of a charge or equity by its passing into the hands of the owner of the lands charged; and it has been sometimes used in the sense of payment.("Corpus Juris Secundum", Vol. 35, p. 352) 1, record 25, English, - extinguishment

1, record 61, French, - option%20permettant%20d%27avancer%20la%20date%20d%27%C3%A9ch%C3%A9ance%20du%20swap
