Traditionally, trialists are people whose careers are built on conducting clinical trials that provide the evidence base needed for the high-quality practice of medicine. Because trialists have expertise in the condition to be studied by a trial, in the science of designing and conducting trials, or both, they are able to frame the research questions, study the key variables, perform state-of-the-art outcome measurements pertinent to the study question, and determine how best to gather that information.

This same approach should be applied to the question of reading in since extension by way of reading in is closely akin to the practice of severance. The difference is the manner in which the extent of the inconsistency is defined. In the usual case of severance the inconsistency is defined as something improperly included in the statute which can be severed and struck down. In the case of reading in the inconsistency is defined as what the statute wrongly excludes rather than what it wrongly includes. Where the inconsistency is defined as what the statute excludes, the logical result of declaring inoperative that inconsistency may be to include the excluded group within the statutory scheme. This has the effect of extending the reach of the statute by way of reading in rather than reading down.

Should architecture obey, deny or subvert the logic of "the plan"? This question has continued to haunt the theory, polemics and practice of architecture throughout the latter half of the twentieth century. It is a simmple question, yet one which can be considered at many levels and from many points of view, challenging the established professional boundaries of the architect, the role of the official urban planner and forcing an investigation of the scope of the lay consumers's of architecture to seize control of the forces which manipulate the design and construction of the buildings and cities around them.

CONT

The practice of a state is shown by its acts and attitudes in its international relations with other states. When it becomes clear that each state acts in the same way, or takes up the same attitude to the acts or omissions of other states, the practice is uniform. When there is a repetition of such uniform practice over a period of time, the practice is constant. State practice which is both uniform and constant creates a "usage". Custom requires a "general practice". No precise answer can be given to the question of how general the practice needs to be. So long as a group of states follow the practice, and accept it as law, there is a custom. All customs have begun in the same way, and become of increasingly universal application as more states align their practice to them.

Transfer of goods at sea likewise forms part of the larger subject of enemy character, for the question here also is whether such a transfer divests these goods of their enemy character, and there was likewise no unanimous practice among the maritime States when the Naval Conference met in London in 1908-1909. British and American practice has always refused to recognise a sale after the outbreak of war of goods in transitu if the vessel was captured before the neutral buyer had actually taken possession of the goods. On the other hand, it seems that French practice used to recognise such a sale in transitu provided it could be proved to have been bona fide.
