In a tenancy in common each tenant owns an undivided interest in the entire estate. It is sometimes spoken of as a "sole and several tenancy". The unity of possession in a tenancy in common is a several unity, not a joint unity as in joint tenancy. A several unity permits alienation of a tenant in common's interest in the estate without destroying the common tenancy relationship between the co-owners....(Cartwright, 1972, p. 866).

Historically, the word "mortmain" is derived from the Norman-French meaning a "dead hand" because, said Coke, "the lands were said to come to dead hands as to the lords, for that by alienation in mortmaine they lost wholly their escheats, and in effect their knights-services for the defence of the realms, wards, marriages, reliefs, and the like; and therefore was called a dead hand, for that a dead hand yieldeth no service. (Anger & Honsberger, 2nd ed., 1985, p. 1489)

In joint ownership or joint tenancy of land there is a single title, interest, time of commencement and unity of possession. The right of survivorship exists so that, on the death of any joint owner, his rights are extinguished and vested in the survivors until the last survivor becomes sole owner of the property. Joint ownership of real property may be severed and the right converted into tenancy in common.("Oxford Companion to Law", 1980, p. 667).

A joint ownership or joint tenancy is distinguished by the four unities of possession, interest, title and time of commencement. The right of survivorship attaches to a joint tenancy of personalty, including choses in possession and in action, as well as to realty until severance. (35 Hals., 4th, p. 637)
