"delivered at frontier" means that the seller delivers when the goods are placed at the disposal of the buyer on the arriving means of transport not unloaded, cleared for export, but not cleared for import at the named point and place at the frontier, but before the customs border of the adjoining country. The term "frontier" may be used for any frontier including that of the country of export. Therefore, it is of vital importance that the frontier in question be defined precisely by always naming the point and place in the term. However, if the parties wish the seller to be responsible for the unloading of the goods from the arriving means of transport and to bear the risks and costs of unloading, this should be made clear by adding explicit wording to this effect in the contract of sale. This term may be used irrespective of the mode of transport when goods are to be delivered at a land frontier. When delivery is to take place in the port of destination, on board a vessel or on the quay(wharf), the DES or DEQ terms should be used. 3, record 15, English, - delivered%20at%20frontier

4, record 15, French, - rendu%20fronti%C3%A8re

The fact, "simpliciter", that the parties to an instrument are described as "assignor" and "assignee" does not make the instrument, which in substance is a sub-agreement of sale, an assignment. There is no privity of contract between the head-vendor and a sub-purchaser. A sub-agreement does not operate as an assignment of the head agreement but is a separate and independent contract, and, thus, a sub-purchaser has no direct claim against the head-vendor and he is thus free to impose such terms as he sees fit as consideration for a transfer directly from himself to the sub-purchaser.(Di Castri, 2nd ed., 1975, p. 413) 1, record 17, English, - sub%2Dagreement%20of%20sale

The main types of non-price competition are product differentiation and advertising. Through product differentiation, a firm tries to distinguish its product from that of its rivals. This may be achieved by improving the product's quality, efficiency, etc., and by periodic restyling. Besides changing its product to suit consumer demand, a firm may try to increase its share of the market by attracting consumers by means of advertising and sales promotion. Less important types of non-price competition include favourable terms of sale and customer services. 1, record 31, English, - non%2Dprice%20competition

"delivered duty paid" means that the seller delivers the goods to the buyer, cleared for import, and not unloaded from any arriving means of transport at the named place of destination. The seller has to bear all the costs and risks involved in bringing the goods thereto including, where applicable, any "duty" (which term includes the responsibility for and the risks of the carrying out of customs formalities and the payment of formalities, customs duties, taxes and other charges) for import in the country of destination. 3, record 40, English, - delivered%20duty%20paid

delivered duty paid : Whilst the EXW term represents the minimum obligation for the seller, DDP represents the maximum obligation. This term should not be used if the seller is unable directly or indirectly to obtain the import license. However, if the parties wish to exclude from the seller's obligations some of the costs payable upon import of the goods(such as value-added tax : VAT), this should be made clear by adding explicit wording to this effect in the contract of sale. If the parties wish the buyer to bear all risks and costs of the import, the DDU term should be used. This term may be used irrespective of the mode of transport but when delivery is to take place in the port of destination on board the vessel or on the quay(wharf), the DES or DEQ terms should be used. 3, record 40, English, - delivered%20duty%20paid

2, record 40, French, - rendu%20droits%20acquitt%C3%A9s

Dispossession : deprival of the right to possess a thing, including the right to occupy land and buildings, and meaning in its widest sense deprival of the right to own it. The French and Spanish terms, as well as dispossession and eviction, apply theorically to all forms of property, but all of them are used in particular of land and buildings; this is especially true of eviction, to which dispossession should therefore be preferred unless the context clearly indicates that the eviction concerns land and buildings, e. g. in the case of squatters being evicted from housing by court order. The dispossession referred by the French and Spanish terms is that suffered by a purchaser or a lessee or hirer of property as a result of a claim by a party extraneous to the sale or the lease or hire and includes threat at dispossession and harassment. 1, record 44, English, - dispossession%20action
