CONT

Between 1871 and 1877, the federal government and First Nation peoples in western Canada signed seven treaties(Treaties 1 to 7). These treaties, which established reserves and promised First Nation peoples traditional hunting and fishing rights, were essentially viewed by the federal government as documents that set out the terms by which it purchased First Nation lands.

CONT

  • Treaties and Conventions
DEF

In international law, a formal written agreement elaborated usually according to classical diplomatic procedures between two (bilateral) or more (multilateral) States, probably still subject to ratification

OBS

Conventions are a primary source of international law, and directly subject to international law, being practically indistinguishable from treaties... since neither of these terms, like declarations, acts, protocols, etc., have an absolutely fixed meaning.

OBS

Canadian international agreements employing the term "convention" in the title almost invariably require ratification. "Convention" is more widely employed in Canadian practice than the term "treaty."

DEF

  • War and Peace (International Law)
CONT

The term "peace treaty" usually refers to a treaty between belligerents ending a war, through sometimes it refers to a treaty to prevent future wars. The two concepts are often combined, because in treaties ending wars, the parties have often pledged themselves to "perpetual peace". The terms of such treaties, however, are often so onerous that they stimulate the defeated state, which has signed under duress, to renew hostilities when the opportunity arises.

Deposit of ratifications.... The exchange of ratifications is ordinarily restricted to bilateral treaties. In the case of multilateral treaties ratifications are deposited according to the terms of the treaty, either in the archives of a particular government or with the Secretary-General of the United Nations.

CONT

Ratification involves two distinct procedural acts: the first is the act of the appropriate organ of the state, which is the Crown in the United Kingdom, and may be called ratification in the constitutional sense; the second is the international procedure which brings a treaty into force by a formal exchange or deposit of the instruments of ratification.
