A person in need of protection is a person in Canada whose removal to their country or countries of nationality or, if they do not have a country of nationality, their country of former habitual residence, would subject them personally(a) to a danger, believed on substantial grounds to exist, of torture within the meaning of Article 1 of the Convention Against Torture; or(b) to a risk to their life or to a risk of cruel and unusual treatment or punishment if(i) the person is unable or, because of that risk, unwilling to avail themself of the protection of that country,(ii) the risk would be faced by the person in every part of that country and is not faced generally by other individuals in or from that country,(iii) the risk is not inherent or incidental to lawful sanctions, unless imposed in disregard of accepted international standards, and(iv) the risk is not caused by the inability of that country to provide adequate health or medical care.

For the purposes of this Convention, torture shall be understood to be any act intentionally informed whereby physical or mental pain or suffering is inflicted on a person for purposes of criminal investigation, as a means of intimidation, as personal punishment, as a preventive measure, as a penalty, or for any other purpose. Torture shall also be understood to be the use of methods upon a person intended to obliterate the personality of the victim or to diminish his physical or mental capacities, even if they do not cause physical pain or mental anguish.

The Swedish Aliens act sets out the categories of people who are entitled to proctection in Sweden. Clarity, credibility and humanity are the watchwords of the legislation. A person who feels a well-founded fear of persecution on grounds of race, nationality, membership of a particular social group, or religious or political conviction is given asylum under the Geneva Convention. Others in need of protection are those who risk capital punishment, torture or other inhuman or degrading treatment or punishment, those who are fleeing from internal or external armed conflict or environmental disaster, and those who are subject to persecution because of their gender or homosexuality. In mass migration situations the Government can authorise temporary two-year residence permits.
