A breach of contract, no matter what form it may take, always entitles the innocent party to maintain an action for damages, but the rule established by a long line of authorities is that the right of a party to treat a contract as discharged arises only in two types of case. Firstly, where the party in default has repudiated the contract before performance is due or before it has been fully performed. Secondly, where the party in default has committed what in modern judicial parlance is called a fundamental breach.

A line shared by two subscribers.

OBS

When a customer is talking over the telephone, the other customer who shares the line with him cannot make a telephone call and is able to hear the conversation if he picks up the phone. He will have to wait for the line to be free before placing his call. Also, when the telephone rings, the two subscribers do not know if the call is theirs or not. A two-party line diminishes the privacy of calls.

OBS

Les deux abonnés ne peuvent pas utiliser la ligne simultanément. Si l'un deux parle au téléphone et que l'autre décide de faire un appel, ce dernier va entendre la conversation et devra attendre que l'autre abonné raccroche avant d'effectuer son appel. De plus, quand le téléphone sonne, les deux abonnés ne peuvent savoir pour qui l'appel est destiné avant de décrocher. Une ligne à deux abonnés réduit la confidentialité des appels.
