Il s'agit d'une situation rare où le jury choisit, en connaissance de cause, de ne pas appliquer la loi et acquitte l'inculpé sans égard au poids de la preuve. Pour la Cour, d'utilisation rarissime, ce concept inusité pourrait s'expliquer par l'oppression découlant d'une loi sévère ou de son application stricte.
