Overholding with consent. Until rent is paid or something said or done on the part of the landlord to indicate an intention to treat the tenant holding over as his tenant for a further term, the landlord may treat him as a trespasser and bring an action of ejectment. When, however, a tenant is allowed to continue in possession after the expiration of a tenancy by agreement, the terms on which he continues to occupy are matters of evidence rather than of law. If there is nothing to show a different understanding he will be considered to hold on the terms of the old lease in so far as these terms are applicable. It is also a question of intention whether the parties, when the lease provides for overholding, intend the tenant to remain under the overholding provisions or under a new lease.(Anger and Honsberger, 2nd, p. 285-286)

The Caribbean Basin Economic Recovery Act(CRERA), which was enacted on August 5, 1983(Public Law 98-67, title II), contains the trade component of the Caribbean Basin Initiative(CBI) that was launched in 1983 to expand private sector opportunities and investment in nontraditional sectors of the Caribbean Basin Beneficiaries as a way to help them diversify their economies and expand their exports. The CBERA authorized the President to proclaim duty-free treatment to eligible articles from designated beneficiary Caribbean Basin countries and dependent territories. The first proclamations and designations under the Act took effect on January 1, 1984. The Act was scheduled to remain in effect until September 30, 1995, but was expanded in 1990 by the Basin Economic Recovery Expansion Act(Public Law 101-382, title II) with no statutory expiration date. The primary goal of CBERA is to promote export-oriented growth in the Caribbean Basin countries and to diversify their economies away from such traditional agricultural products and raw materials as aluminum, bananas, coffee, petroleum, and sugar.

It is a common practice to open a Convention for signature by certain States until a certain date after the date of the formal session of signature. Generally, this period does not exceed nine months. The object is to obtain as many parties to the Convention as possible, but inasmuch as new signatories can only be allowed with the consent of the original signatories, a special clause to this effect must be inserted in the Convention. A current practice is to open a Convention for signature to all members of the United Nations and the specialised agencies, to all parties to the Statute of the International Court of Justice, and to any other State invited by the General Assembly. During the period mentioned, each State may sign at any time, but after the expiration of the period no further signatures are allowed and a non-signatory State desiring to become party must accede or adhere to the Convention but cannot ratify, inasmuch as it has not signed the instrument.
