L'indignité, quant à elle, est spécifiquement prévue au Code civil du Québec, aux articles 620 et 621 [du Code civil du Québec]. Le législateur exclut ainsi de la succession certaines personnes qui ont commis, à l’égard du de cujus, certains actes prédéterminés. [...] Depuis l'adoption du Code civil du Québec, l'indignité peut exister de plein droit, ou être déclarée judiciairement à la demande expresse d’un successible. Auparavant, l’indignité dans les successions ab intestat n'était pas régie par les mêmes dispositions que celles applicables aux successions testamentaires et n’était pas toujours interprétée de la même façon. Dorénavant, l'indignité successorale s'applique tant aux successions ab intestat que testamentaires.
