CONT

Death certificates provide information not only on the number of deaths and the decedent's characteristics(e. g. age, sex, race, usual occupation) but also on the conditions which led to death.

OBS

Not to be confused with "death record" and "medical certificate of death." The term "death certificate" generally refers to a copy of the death record.

English

Subject field(s)
  • PAJLO
  • Property Law (common law)
DEF

An occupation of realty inconsistent with the right of the true owner. (Jowitt’s, 2nd ed., 1977, p. 60)

OBS

It seems quite clear that the modern use of the term "adverse possession" is to some extent a misnomer. The possession which now extinguishes title under the "Limitation of Actions Act" is different than the possession which was termed "adverse possession" prior to the "Real Property Limitation Act", 1833(UK), c. 27... The usual description of the type of possession necessary for adverse possession in Canada is that it is "an actual possession, an occupation exclusive, continuous, open or visible and notorious" for the requisite period...(Mendes Da Costa & Balfour, 1982, pp. 600-601)

Record 5 2006-11-07

English

Subject field(s)
  • Official Documents
DEF

A right or permission granted in accordance with law by a competent authority to engage in some business or occupation, to do some act, or to engage in some transaction which but for such license would be unlawful ...

OBS

The term "licence" is not invariably translated by the French "licence" although it is in most cases. The reason is that in English the term does not necessarily imply a business or occupation as does the French :"driver's licence" and "marriage licence" are examples of this. One must therefore be careful in translating "licence"--its usual French equivalent is "licence", but in some cases it can be "permis". An important characteristic distinguishing "licence" from "permit" is the fact that the former is not issued directly by the government but rather by a competent authority or by local authorities, while any of the three groups mentioned can issue a permit. Also, the licence is usually granted for an extended period of time whereas the permit normally authorizes an act of short duration. For example, we say "driver's licence", but "learner's permit".

OBS

In Canada the British spelling (licence) is used more often than the American spelling (license), although both are found in Canadian texts.

OBS

"Licence" is one of two words that in Canadian English are usually spelled differently as nouns and verbs. The preferred spelling for the noun is "licence" and for the verb "license" ... The spellings of the other word are "practice" and "practise".

OBS

licence: term standardized by the Canadian General Standards Board (CGSB).

French

Domaine(s)
  • Documents officiels
DEF
