Le conflit d'intérêts n'est pas illégal en soi, car un certain nombre de mesures sont prévues en pareil cas. Les conflits d'intérêts ne sont généralement pas une menace pour la solvabilité des institutions, mais ils en sont une pour les intérêts du client. Et pour la plupart des intermédiaires, un code de déontologie prévoit des sanctions disciplinaires à l'endroit des contrevenants.
