A burden, obstruction, or impediment on property that lessens its value or makes it less marketable.

An emcumbrance (also spelled incumbrance) is any right or interest that exists in someone other than the owner of an estate and that restricts or impairs the transfer of the estate or lowers its value. This might include an easement, a lien, a mortgage, a mechanic's lien, or accrued and unpaid taxes.

Priority of lien. Any lien registered under this Act shall take priority over any mortgages or encumbrances to the extent the lien arises from work, services, or materials provided to the mine for a period of up to 60 days.

The word "encumbrance" is not a technical term. Rather, it is a general expression and must be interpreted in the context in which it is found. It has a broad meaning and may include many disparate claims, charges, liens or burdens on land. It has been defined as "every right to or interest in land granted to the diminution of the value of the land but consistent with the passing of the fee". Even this definition, broad as it is, is not comprehensive enough to cover all possible encumbrances... (Anger and Honsberger, 2nd, p. 1685)
