It is not enough to obtain the consent of the patient. The consent decision must be voluntary, that is, the act of a person who is "so situated as to be able to exercise free power of choice without undue inducement or any element of force, fraud, deceit, duress, or other form of constraint or coercion." ... it means that the person must be free to refuse to participate, and Cahn labels lack of this freedom the "major malpractice of our era, [which is] 'engineering consent'".

Il ne suffit pas d'obtenir le consentement du patient. Ce consentement doit être volontaire, c'est-à-dire qu'il doit être le fait d'une personne qui se trouve «dans des circonstances lui permettant d'exercer un libre choix, en l'absence de toute incitation indue, de toute forme de violence, de dol, de supercherie, de contrainte et d'aucune autre forme de coercition». [ ... ] la personne doit être libre de refuser de participer. Cahn qualifie l'absence de cette liberté de «faute professionnelle du siècle [consistant en] des manœuvres destinées à obtenir le consentement».
