A duty enforceable in a court of chancery or in a court having the powers of a court in chancery.

This equitable duty was restricted: the lender/receiver must act in good faith with the object of preserving and realising assets for the benefit of the lender; it must take reasonable care to sell the property for a proper price.

Le "trustee" a été défini dans l'arrêt Smith v. Andersson comme étant « la personne qui est le possesseur des biens, qui les gère en tant que directeur, que possesseur, que maître et qui est seulement soumis à une obligation équitable de rendre compte à certaines personnes, pour lesquelles il se trouve dans la relation de trustee, qui sont des cestuis que trust ».
