No formality is required for a lease (i) - which takes effect in possession, (ii) for a term not exceeding three years, whether or not the lessee is given power to extend the term, (iii) at the best rent reasonably obtainable without taking a fine.... A "fine" in this sense is a lump sum payment made in consideration of a reduced rent; it is often called a "premium." [Megarry & Wade, 4th ed., 1975, p. 622].

A ... method of conveying land at common law was the fine. A fine was a "finalis concordia" or final compromise in an action commenced for the express purpose of reaching such a compromise and entering it in the court records. If one person, X, wished to transfer land to another, Y, Y would "levy a fine", that is, bring action against X and in the compromise X would acknowledge Y's right to the interest in the land. The fine was used where a feoffment was not possible, such as in the barring of entails. (Anger & Honsberger, 2nd ed., 1985, p. 33)

Des tanins fins sont des tanins bien fondus souvent qualifiés de veloutés. A l'opposé nous qualifierons les tanins de «asséchants» ou «astringents».

OBS

An alternative to a suspension, where a financial penalty is considered preferable for operational or economic reasons. For example, in situations involving mass unlawful withdrawal of services, continuous shift operations, ships at sea, and isolated posts, it may be difficult to schedule suspensions without the use of replacements and overtime.
