Dans le système du standard minimum ou du standard international le traitement que l'État doit accorder aux étrangers en vertu du droit international ne serait pas déterminé par celui qu'il accorde à ses propres nationaux, mais par celui dont les étrangers jouissent dans l'ensemble des pays civilisés, plus exactement par le minimum de droits qui leur est assuré dans ces pays. C'est ce minimum, commun à l'ensemble des pays civilisés, qui marquerait le niveau au-dessous duquel l'État ne peut pas descendre sans enfreindre ses obligations internationales.
