Théorie considérant que pour être retenu comme cause d'un dommage, un fait doit en être la condition nécessaire.

CONT

On entend par là la condition «sine qua non», c'est-à-dire celle sans laquelle le dommage ne se serait pas produit. [...] Contrairement à la théorie de l'équivalence des conditions, la théorie de la causalité adéquate rejette cette équivalence pour déclarer que toutes les conditions nécessaires ne pourront être retenues comme causes; on ne retiendra que celles qui sont unies au dommage par un rapport de causalité adéquat.
