The expression "without authority" in paragraphs 75(b), 75(c) and 75(f) of the National Defence Act signifies that the accused person acted or omitted to act with neither the approval of a competent superior nor the sanction of law, practice or custom. If the evidence adduced by the prosecution, taken by itself, tends to show that the accused person acted without authority, a service tribunal may find them guilty unless the person establishes that they had authority.
