The Federal Court decision was appealed to the Federal Court of Appeal (FCA) by the Attorney General. In December 2008, the FCA quashed the decision of the Federal Court, concluding that the Registrar was entitled to conduct an investigation once he had reasonable grounds to believe that a breach of the Code had occurred, even if the person under investigation had not registered as a lobbyist. 1, record 2, English, - breach%20of%20the%20Code
