Antes de la Convención de Viena era corriente en la doctrina y en la práctica la distinción entre tratados, de una parte, y acuerdos en forma simplificada, de otra. Los tratados(treaties) eran celebrados por los órganos estatales investidos de competencias al respecto(normalmente firma en representación del ejecutivo y ratificación posterior con autorización del legislativo, siendo esta última la que expresaba el consentimiento del Estado en obligarse). La celebración era mediata, en cuanto se descomponía en varios actos : negociación firma, y ratificación. Y el instrumento era único. Por el contrario, los acuerdos en forma simplificada(agreements) se concluían por el Ministerio de Asuntos Exteriores o el jefe de la respectiva misión diplomática, no estaban sujetos a ratificación, sino que obligaban por la firma, y podían manifestarse en más de un instrumento jurídico(canje de notas).
