El objeto de la protección diplomática es la reparación del daño causado, mediando reclamación entre los Estados, toda vez que, el individuo afectado endosa a su propio gobierno el planteamiento de la reclamación. A su vez, para que dicho endoso sea admisible, son necesarias tres condiciones: en primer término, el vínculo jurídico o político entre el individuo afectado y el estado que hace la reclamación; en segundo lugar el agotamiento de los recursos internos por el particular reclamante; y, por último, la conducta correcta del reclamante, es decir, que a su vez, no haya observado una conducta irregular o ilegal.
