La sala en lo penal del Superior Tribunal de Justicia, en las decisiones que adopte en ejercicio de la competencia que este Código le atribuye (Art. 70) es el tribunal de última instancia en materia penal de la Provincia del Chubut a los fines del recurso extraordinario federal, salvo que la decisión conforme con la Constitución y este Código debe ser pronunciada por el Superior Tribunal de Justicia.
