Shrink-wrap Agreement or License: A contractual agreement that a user views and agrees to (by removing software cellophane wrapping or other packaging, which indicates the user's consent to the agreement's terms) as a condition of using the software.

OBS

The term "shrink-wrap" derives from the fact that such agreements used to be included on the outside of the software packaging, visible through the clear plastic shrink-wrap with which the package was sealed.

The terms of agreement are contained on or in a shrinkwrapped package. These terms usually provide that if the customer opens the shrinkwrap package, he or she is deemed to have accepted the contract. They are common in software packages and may not be enforceable in certain cases.

The shrink-wrap license agreement purports to create a binding legal agreement (so it says) between the software vendor and the user. The agreement is usually found inside the box containing the software, printed on the envelope containing the CD-ROM or disks, or stated in the user manual. At the beginning appears the usual statement warning the user not to open the software envelope or use the software if he or she does not agree with the terms and conditions of the agreement

Shrink wrap license agreement. This agreement creates a limited, non-exclusive license between the producer of software and the purchaser, allowing the purchaser to use the software in the manner described in the license. This type of agreement does not need to be signed in order to be enforceable.

Type of passive contract which the buyer of a software is deemed to accept by the fact of opening its shrinkwrapped package. This license usually includes terms that (1) prohibit making unauthorized copies, (2) prohibit any modification, (3) prohibit resale, (4) limit use to one or a specified number of computers, (5) limit publisher's liability.

Shrink-wrap license.- In the computer industry the terms of the software license are usually printed clearly on a sticky seal or are readable on the box, which is covered with a “shrink-wrap” film. Within the box are the disks and manuals and there is usually a notice that says that if you need to return the software the packages must be unopened with the shrink-wrap intact and that software with broken seals will not be reed.
