In International Law, equity may be considered a secondary source, and by Article 38(2) of the Statute of the International Court of Justice, referring to Article 38(1), «This provision shall not prejudice the power of the court to decide a case ex aequo et bono, if the parties agree thereto». Though the Court has thus not been expressly authorized to apply equity as distinguished from law, Article 38(1) c) expressly directs the application of «general principles of law recognized by civilized nations» ... and in several States, as noted above, principles of equity have an established place in their municipal legal systems. No doubt the international judge can decide according to principles of equity in absence of rules of positive law, but it is doubtful whether he can decide «contra legem», i.e. contrary to such rules when they exist. 1, record 1, English, - equity

1, record 1, French, - %C3%A9quit%C3%A9

Agreement reached by the majority of the governments of the world, meeting in Canada in 1987 and in force since 1989. It was the continuation of the Vienna Treaty dealing with the destruction of the ozone layer and the limiting of CFC production. Some third world countries refused to sign the 1990 London agreement in which the industrialized countries agreed to transfer adequate technology to substitute CFC's with less harmful substances to developing countries. 3, record 2, English, - Montreal%20Protocol%20on%20Substances%20that%20Deplete%20the%20Ozone%20Layer
