Le système juridique reconnaît tout à la fois la différence et l'égalité des sexes, sans donner aucune définition du sexe. Élément d’identification de la personne, le sexe est mentionné dans l'acte de naissance en considération de l'apparence des organes génitaux externes. Il est pourtant impossible de ramener le sexe à un seul élément anatomique. Le sexe est en effet une donnée biologique complexe, reposant sur plusieurs composantes.
