D'ailleurs le voilier rattrapé, s’il doit se conformer à la règle 39, c'est-à-dire ne pas laisser porter au-delà de sa route normale, lorsqu'il se trouve à moins de trois longueurs hors tout en avant ou au vent du yacht le plus long(pour empêcher le voilier le plus rapide de le dépasser), a en revanche, le droit de lofer, comme il lui convient(art 38-1) pour empêcher l'autre de passer.
