This is the usual method of entitling a judicial proceeding in which there are not adversary parties, but merely some res concerning which judicial action is to be taken such as a bankrupt's estate, an estate in the probate court, a proposed public highway, etc. It is also sometimes used as a designation of a proceeding where one party makes an application on his own behalf, but such proceedings are more usually entitled "Ex parte"

L'expression «otherwise detained» est employée dans un arrêt de la Cour d’appel de l'Ontario(Re Bazouzi and the Queen, CCH DRS 1983 p 17-110, O.(1983) 3 C. C. C.(3d) 386(Ont., C. A. ] pour désigner ce que l'article 457(1) du Code criminel désigne par les mots «detained in custody in respect of any other matter». Cette expression a été reprise dans les ouvrages de doctrine et rendue en français par «détenu relativement à une autre affaire». On trouve aussi dans la version française du Code criminel l'expression «détention requise pour une autre affaire»(article 519(1) C. Cr. 1989). L'article 457(1) a été modifié et remplacé par l'article 515(1) du Code criminel, édition de 1989.
