"There is no distinction more deeply rooted in the common law than that between misfeasance and nonfeasance, between active misconduct working positive injury to others and passive inaction..." (...) This distinction, admittedly a difficult one to draw in practice, is supported by some and attacked by others. In any event, courts do apply different concepts to cases of inaction than they do to cases of positive action.
