Une bonne administration de la justice suppose que le juge puisse bénéficier de l'assistance d’un expert «jurilinguiste», lorsqu'il interprète des textes juridiques rédigés dans une langue étrangère ou enfin, lorsque la traduction d’un terme de droit étranger est discutable. L'intervention d’un expert-traducteur, véritable auxiliaire de la justice, que l'on pourrait qualifier de «jurilinguiste» est d’autant plus nécessaire, lorsque l'on connaît les difficultés de la traduction juridique. En fait, la traduction juridique est un art difficile qui nécessite, de la part du traducteur, des connaissances linguistiques associées à une parfaite maîtrise de la terminologie et des concepts propres à deux systèmes juridiques. Une mauvaise traduction de termes juridiques peut conduire à des erreurs préjudiciables à une bonne interprétation de l'intention des rédacteurs du texte qui est soumis au juge. Aujourd’hui, l'exercice d’une telle mission est confiée, par les tribunaux français, aux Traducteur-Jurés ou encore aux Experts Judiciaires de la Compagnie des Experts Judiciaires, près les Cours d’Appel et les Tribunaux Administratifs. Le rôle du traducteur-expert «jurilinguiste» en France sera d’éclairer le juge qui, selon la jurisprudence française dispose d’un pouvoir souverain d’appréciation pour interpréter un texte juridique en langue étrangère. En ce sens, il intervient comme un auxiliaire de la justice. Mais ses compétences en matière de traduction juridique peuvent être tout aussi bien sollicitées par les particuliers, ou par toute personne publique ou privée qui désirerait éviter des litiges ultérieurs, en ayant recours aux services d’un professionnel. Son expérience est précieuse et peut éclairer notre débat.
