Le terme condamnation est souvent utilisé à mauvais escient pour désigner le fait de déclarer l'accusé coupable d’une infraction. Il s’agit en fait d’une mauvaise traduction du terme anglais «conviction». Il faut bien distinguer l'étape de la déclaration de culpabilité et celle de la condamnation à une peine quelconque. En effet, à l'issue d’un procès pénal, le tribunal doit se prononcer sur la culpabilité de l'accusé, c'est-à-dire le déclarer coupable ou non coupable. Dans le premier cas, il y a déclaration de culpabilité et, dans le second, il y a déclaration de non-culpabilité, qu'on appelle aussi acquittement.
