The terms "rape" and its explanation "forced sexual intercourse", found in several texts, are both legally vague in that one does not know to what degree the victim was abused sexually. One might ask oneself, was the victim mistreated sadistically? Was the act premeditated? Furthermore, the related term "sexual assault" is not a precise synonym of "forced sexual intercourse", because technically one can assault someone else without performing coitus. Quoique les termes «accouplement», «coït», et «copulation» représentent des traductions adéquates pour le terme «sexual intercourse», elles ne sont pas appropriées en psychologie criminelle à moins que l’on parle de l’acte biologique. Par contre, on peut utiliser le terme relations «sexuelles» s’il s’agit d’un consentement entre adultes, d’où le terme «relations sexuelles sous la contrainte entre conjoints» . Mais si l’on ignore le rapport entre deux sujets donnés, ou si on veut ne décrire que l’acte sexuel sans mention de lien ou de consentement, il serait donc préférable d’utiliser le terme «rapports sexuels». Or, si on parle du «rapports sexuels sous contrainte», on décrit probablement un des 4 types de viol décrit dans le Code criminel canadien selon lequel «la notion légale de viol» (terme non qualifié) n’existe plus depuis février 1983 au Canada (mais existe toujours en France, voir le code pénal de ce pays). Elle a été remplacée par celle d’«agression sexuelle» dont la gravité, comme n’importe quelle autre voie de fait, dépend du degré de violence exercée (voir l’observation suivante). Pour ce qui est du terme «agression sexuelle», il ne comporte pas nécessairement la notion de pénétration. De plus, le terme anglais «forced sexual intercourse» peut décrire un type de viol ou plusieurs, selon le cas.
