Selon la Cour des comptes, l'agent contractuel est celui qui n’ est ni titulaire de la fonction publique, ni ouvrier d’État(agent non-titulaire) et c'est cette double négation qui est à l'origine du caractère précaire de la situation de ces agents. C'est pour cette raison que l'agent «contractuel» est recruté par contrat par opposition au fonctionnaire qui est recruté par voie de concours.
