The fact that the word "status" does not restrict the statute in the manner proposed by the appellants is clear from the way the term has been qualified in the case law, and in the submissions of the parties. The very issue in this appeal has been characterized as whether s. 5(1) of the Code includes complaints based on "relative status" as opposed to "absolute status". The essence of the appellants' argument is that the ordinary meaning of the word "status" refers to an absolute condition; the inclusion of relative status within the scope of the definition would require the addition of a qualification. We cannot agree. The word "status" is equally capable of encompassing both the absolute definition and the relative definition. Moreover, the terms "marital status" and "family status" are in themselves relative. That is, they require the existence or absence of a relationship with another person. La question même que pose le présent pourvoi a été formulée de la manière suivante : Le paragraphe 5(1) du Code s’applique-t-il à la discrimination fondée sur «l'état au sens relatif »par opposition à «l'état au sens absolu »? Essentiellement, les appelants affirment que, considéré dans son sens ordinaire, le mot «état »s’entend d’une situation absolue; l'inclusion de la notion d’état au sens relatif dans le champ d’application de la définition exigerait l'ajout d’une réserve. Nous ne pouvons retenir cet argument. Le mot «état »peut recevoir à la fois la définition absolue et la définition relative. Qui plus est, les termes «état matrimonial »et «état familial »sont en eux-mêmes relatifs, c'est-à-dire qu'ils requièrent l'existence ou l'absence d’un lien avec une autre personne.
