2, record 15, French, - %C3%A9tat%20de%20mal%20%C3%A9pileptique

An alternative emission-reduction plan offered in state implementation programs for air pollution control [which] allows an industrial facility to reduce controls in a part of its plant where pollution control costs are high, in exchange for a comparable increase in pollution control in another part of the same plant where abatement is less expensive. 2, record 24, English, - bubble%20concept

Since the EPA [U.S. Environmental Protection Agency]-sponsored proposal treats an industrial facility in terms of its total emissions as if it had a bubble over it the program is known as the bubble concept.

The difference between a determinable fee and a fee simple defeasible by condition subsequent is not always easy to discern. The essential distinction is that the determining event in a determinable fee itself sets the limit for the estate first granted. A condition subsequent, on the other hand, is an independent clause added to a limitation of a complete fee simple absolute which operates so as to defeat it. ... Words which form a separate clause of defeasance, such as "provided that," "on condition that," "but if," or "if happen that," operate as a condition subsequent. In parts of the United States, real estate is customarily sold through a process known as an escrow closing. In such a closing, the buyer and seller do not meet face to face for an exchange of documents and consideration; rather, the purchaser deposits with the escrow agent the agreed purchase price and such other documents as may be required, while the seller deposits with the escrow agent the executed deed to the property and related documents. In addition, if financing by a lender is to be provided, the mortgage or deed of trust and its related instruments are also deposited with the escrow agent. When the agent has received all of the necessary documents and cash, it will consummate the transaction and title will pass to the purchaser. Between the time that a document or cash is deposited with the escrow agent and the transaction is consummated, the items deposited are considered to be "in escrow". The doctrine of "escrow" is a relic of medieval times. It dates from the time when conveyances were made by feoffment and livery of seisin. It has survived to the present day and often operates in regard to conveyances of land or the creation or disposition of estates and interests in land such as a term of years.... It does predicate a document which is executed and delivered. The accustomed formula is "signed, sealed and delivered". When that formula is used in the document and it is signed by the party (or in the case of a company its seal is affixed) and attested by a witness with intent by the maker that it should be binding on him, it is conclusively presumed to be "signed, sealed and delivered". If it is handed over to another unconditionally, it is delivered as a deed. If it is handed over to another conditionally, it is delivered as an escrow. It only becomes a deed when the conditions are fulfilled.... (Words and Phrases/England, v. 2, p. 173) 1, record 55, English, - doctrine%20of%20escrow

Under the old law, a deed could not be delivered, as an escrow, direct to the grantee. Delivery in escrow was made to a third party - the first delivery - and, upon the fulfilment of the condition, the third party would deliver the deed to the grantee - the second delivery. It seems that the old law no longer applies. The more modern approach is to treat the question as one of fact; even where there is delivery to the grantee, the intention of the parties must be ascertained, from the transaction as a whole, as to whether the delivery was absolute or conditional. 1, record 73, French, - %20facteur%20de%20discontinuit%C3%A9
