In 1997, the Supreme Court of Canada ruled in the Delgamuukw case that Aboriginal title is a property right to the land itself - not just the right to hunt, fish and gather. [An] Aboriginal title is a communal right; an individual cannot hold [an] Aboriginal title.

Aboriginal title: A legal term that recognizes an Aboriginal interest in the land. It is based on the long-standing use and occupancy of the land by today's Aboriginal peoples as the descendants of the original inhabitants of Canada.

Trapping for subsistence. Under Chapter 16 of First Nation Final Agreements, beneficiaries have the right to trap furbearers for subsistence (sustenance) within their traditional territory. So, if you are a member of a Yukon First Nation with a Final Agreement, you have the right to trap furbearers in your traditional territory, but you must eat the meat of the animals you trap before using the pelt or other parts. You can then trade, barter or sell the non-edible byproducts, but only to other members of your First Nation or other Yukon First Nations.

En vertu des dispositions du chapitre 16 des ententes définitives des Premières Nations, les bénéficiaires des ententes ont le droit de piéger les animaux à fourrure à des fins de subsistance(nourriture) sur leur territoire ancestral. Si vous êtes membre d’une Première Nation du Yukon ayant conclu une entente définitive, vous avez le droit de piéger les animaux à fourrure sur votre territoire ancestral; cependant, vous devez consommer la viande des animaux que vous piégez avant de pouvoir utiliser la peau ou toute autre partie. Vous pourrez alors échanger, troquer ou vendre les sous-produits non comestibles, mais uniquement à des membres de votre Première Nation ou d’une autre Première Nation du Yukon.

Nitassinan is the ancestral homeland of the Innu people. It covers much of the sub-arctic forest and interior barren lands of the Quebec-Labrador peninsula. The idea of Nitassinan is closely linked to Innu identity. It reflects the physical space that people occupy in the hunting, fishing and trapping activities that sustain them.

Nitassinan cuts through, by and large, the Saguenay-Lac-St-Jean, the Haute-Côte-Nord and Manicouagan RCMs, and the eastern portion of the Minganie RCM.

S’il n’a pas administrativement parlant le statut officiel de territoire, le Nitassinan a été défini à des fins administratives. Le Nitassinan fait en effet l’objet de négociations territoriales impliquant les communautés innues ainsi que les gouvernements du Québec et du Canada. Aux termes de l’«Entente de principe d’ordre général entre les Premières nations de Mamuitun et de Nutashkuan, le gouvernement du Québec et le gouvernement du Canada», les limites du Nitassinan correspondent schématiquement au Saguenay Lac-Saint-Jean, c’est-à-dire aux municipalités régionales de comté (MRC) de la Haute-Côte-Nord et de Manicouagan, de la partie sud de la MRC de Caniapiscau et à la partie est de la MRC de Minganie. Ratifié en mars 2004, ce document définit le Nitassinan comme un territoire de pleine juridiction québécoise sur lequel les Innus disposent de certains droits.
