Les marchés peuvent être passés soit par adjudication ou sur appel d'offres, au choix de la personne responsable du marché, soit sous forme de marchés de gré à gré, dans les cas visés aux articles 65, 74, 104 et 105. Marchés par adjudication. 84. Les marchés par adjudication comportent obligatoirement : 1° La publicité de l'ouverture des soumissions et de l'attribution provisoire du marché; 2° L'attribution du marché, s'il a été reçu au moins une soumission répondant aux conditions de l'adjudication; 3° L'attribution du marché au soumissionnaire le moins-disant. La personne responsable du marché doit fixer un prix maximum au-delà duquel aucune attribution ne peut être prononcée.
