Règle d'interprétation qui trouve son origine dans la décision qui fut rendue par le Comité judiciaire du Conseil privé britannique à l'occasion de l'affaire Edwards v. Attorney General for Canada, [1930] A.C. 124. Dans cet arrêt célèbre, le Conseil Privé a en effet comparé la Constitution canadienne à un arbre susceptible de croître, d'évoluer dans ses limites naturelles, invitant ainsi à une interprétation dynamique de la Constitution du Canada et à une certaine créativité judiciaire.
