The judicial determination of a legal sanction upon a person convicted of an offence.

The fundamental purpose of sentencing is to contribute to the maintenance of a just, peaceful and safe society through the imposition of just sanctions.

OBS

In some cases, the Court has the option to impose a conditional or absolute discharge. A conditional discharge requires the offender to follow certain rules for a specified length of time as set out in a probation order.

El problema se plantea en cuanto al modo de hacer esa graduación y se complica tanto más cuando difiere respecto del criterio o concepto que de la pena se tenga. Si funciona como prevención, en el sentido de que por el temor que infunde resulta idónea para apartar a la gente de cometer un delito, habría que admitir que, cuanto más grave, mejor sirve; pero entonces resulta innecesaria la valoración individual del hecho y de la persona, con lo que no sería justa.
