Partial performance of an entire contract will, as a rule, give no right of action to the person who has partially performed it; but an action will lie on a "quantum meruit" for a reasonable sum against one who has accepted the benefit of the partial performance if the failure to complete the performance was due to his fault or if the parties have agreed to rescind the contract and substitute a new one. what is called the doctrine of part performance is the rule that where a contract for the sale or other disposition of land or any interest in land is not enforceable by action for want of written evidence as required by the Law of Property Act, 1925, s. 40, and it has been partly carried into effect by one of the parties, the other cannot set up the want of writing as a defence: as where possession had been taken under a contract for the sale of land.
