«Costs» se traduit par frais ou par dépens. [...] Les dépens sont la partie des frais engendrés par le procès que le gagnant peut se faire payer par le perdant. Il s'agit donc d'une somme qui n'est pas encore déterminée au moment du jugement, bien qu'elle soit déterminable par la procédure de la taxe (au Canada), ou du calcul (au Nouveau Brunswick). [...] Les dépens sont généralement déterminés en fonction de deux barèmes [...] : a) frais entre avocat et client («solicitor and client costs») b) frais entre parties («party and party costs»). Au Canada, sauf mention contraire, ce sont les frais entre parties qui constituent les dépens.
