Qui peut être franchiseur? Théoriquement, on peut imaginer que ce système s'applique à tous les domaines de l'activité économique, puisqu'il s'agit de la reproduction par plusieurs personnes physiques ou morales d'une activité expérimentée et réussie. En pratique, l'on ne peut se lancer dans une telle aventure, dans n'importe quel domaine. Ainsi, paraissent exclues de ce système certaines professions libérales qui, pourtant, exercent une activité économique, mais sont soumises à des réglementations leur interdisant de reproduire l'organisation qu'elles auraient pu mettre au point ou qui sont soumises à l'interdiction de faire de la publicité (avocats, médecins, notaires, etc).
