The warranty of ownership (articles 1723-1725 C.C.Q. [Civil Code of Quebec]) implies that the seller guarantees that the property is not burdened by any rights, such as a hypothec or right of passage, which he has not revealed to the buyer, unless the buyer assumes the debt secured by such hypothec (article 1723(2) C.C.Q.). This guarantee applies even where the rights affecting the property are published in the appropriate register.

[...] De façon générale, le vendeur doit garantir l'acheteur contre l'existence de tout droit de nature privée qui prive l'acheteur de son droit de propriété ou qui le restreint. Ce sera le cas du droit de propriété d'un tiers, d'une servitude [...] ou d'une hypothèque (article 1723, alinéa 1 C.c.Q). [Code civil du Québec]). Ainsi, le vendeur doit garantir l'acheteur contre l'exercice d'un droit réel sur le bien, que ce soit par un tiers ou par lui-même. Il s'agit d'une garantie contre les troubles de droit. Le vendeur n'a cependant pas l'obligation de dénoncer un droit qui est incertain ou qui a fait l'objet d'une publication dans les registres (article 2943 C.c.Q.).
