The warranty of ownership (articles 1723-1725 C.C.Q. [Civil Code of Quebec]) implies that the seller guarantees that the property is not burdened by any rights, such as a hypothec or right of passage, which he has not revealed to the buyer, unless the buyer assumes the debt secured by such hypothec (article 1723(2) C.C.Q.).
