This recommendation attempts to clearly state the rule against the rendering of inconsistent judgments, or "issue estoppel" ... the doctrine asserts that an issue determined in favour of the accused by a valid and final judgment cannot be litigated between the same parties in any future prosecution.

Nous avons voulu dans cette recommandation énoncer en termes clairs la règle qui s'oppose aux jugements incompatibles (règle de la "chose jugée comme fin de non-recevoir"). Suivant cette règle ... nulle question tranchée en faveur de l'accusé par un jugement valide et sans appel ne peut être soulevée de nouveau entre les mêmes parties à l'occasion d'une poursuite ultérieure.
